**藝術家肖像畫定制服務條款**

 

一、服務內容

1. 本工作室提供專業肖像畫定制服務，客戶可直接聯繫藝術家洽詢創作細節。

 

二、創作流程

1. 前期溝通階段：

• 藝術家將與客戶詳細討論場景設定、服裝風格等創作細節

• 雙方確認需求後安排現場創作行程
   

2. 現場創作階段：

• 藝術家會預先確認環境、光線、服裝等條件後開始拍攝 -

• 視乎需求進行初步繪畫（姿勢確認、光影測試、色彩調整）

• 可能包含速寫或局部上色

3. 後期製作階段：

• 藝術家將篩選拍攝素材並提供電郵預覽

• 共同選定最終參考圖像

• 可提供繪畫前期階段圖像供確認 

• 畫作開始後僅接受局部及少量修改

• 不提供姿勢、服飾及表情等重大修改

• 視需要分享創作進度
   

三、付款方式

1. 訂金規定：

• 確認委託後需支付總費用30%作為訂金

• 訂金支付後方開始創作流程

2. 尾款支付：

• 客戶須於作品交付當日或之前付清70%尾款

• 未付清尾款前不得取走作品

四、重要條款

1. 素材規範：

• 為確保作品質素，恕不接受客戶提供之任何現成照片

• 所有參考素材必須由藝術家親自拍攝取得

2. 作品驗收：

• 建議以原作實物作為最終驗收依據

• 數位圖像可能因設備差異產生色差

3. 退件規定：

若客戶不滿意或拒絕接受作品：

a) 作品所有權及著作權仍歸藝術家所有

b) 已支付之30%訂金不予退還

c) 客戶需自行承擔作品返還之運送費用

d) 藝術家保留作品展示及後續處置之權利

五、客戶配合事項

1. 現場需配合藝術家指導保持穩定姿勢

2. 需及時回覆各階段確認需求

Custom Portrait Painting Service Agreement

​

I. Service Description

Our studio provides professional custom portrait painting services. Clients may contact the artist directly to discuss creative details.

II. Creative Process

Preliminary Consultation Phase:

The artist will discuss scene settings, clothing styles, and other creative details with the client

Upon mutual confirmation of requirements, on-site creation arrangements will be made

 

On-site Creation Phase:

The artist will confirm environmental conditions, lighting, and clothing before commencing photography

Preliminary sketches may be created as needed (for pose confirmation, lighting tests, and color adjustments)

May include quick sketches or partial coloring

 

Post-production Phase:

The artist will curate photographic materials and provide previews via email

Final reference images will be selected jointly

Initial stage images of the painting may be provided for confirmation upon request

Only minor and localized modifications will be accepted after painting commences; major changes (including poses, clothing, and expressions) will not be accommodated

Work-in-progress updates may be shared as needed

III. Payment Terms

Deposit Requirements:

30% of total fee payable upon commission confirmation

Creative process will commence only after deposit payment

Final Payment:

The remaining 70% balance must be paid in full on or before delivery date

Artwork may not be collected before final payment is completed

IV. Key Terms

Material Specifications:

To ensure quality, no pre-existing photographs provided by clients will be accepted

All reference materials must be photographed by the artist personally

​

Artwork Acceptance:

Final acceptance should be based on the original physical artwork

Digital images may exhibit color variations due to device differences

​

Return Policy:

If the client is dissatisfied with or refuses to accept the artwork:

a) All ownership and copyright of the artwork remains with the artist

b) The 30% deposit paid will not be refunded

c) The client shall bear all return shipping costs

d) The artist retains display and disposition rights to the artwork

V. Client Responsibilities

Must maintain stable poses as directed by the artist during on-site sessions

Must provide timely responses at each confirmation stage
